BATON ROUGE, LA (WAFB) - An East Baton Rouge grand jury indicted 15-year-old Michael Nicholas on four counts of attempted second-degree murder Thursday (Oct. 23rd). Nicholas allegedly shot three people, and tried to shoot another person but missed, two weeks ago at the Rite Aid on Plank Road. Prosecutors say he will be tried as an adult. Surveillance video shows, who prosecutors say is Michael Nicholas, enter the Rite Aid. Three customers are lined up to make purchases. The gunman backs up, drops his bag on the ground, and then begins blasting without warning. He then rushes behind the counter, fumbles around a bit, and orders the cashier to open the register. He fires another shot, missing the cashier. Then, you can see the gunman leaving the building only a couple of minutes later. Prosecutors say they plan to introduce the graphic video of the shooting to the jury, when it's eventually seated in this case. Two weeks later, the district attorney's office has charged Nicholas. Prosecutors make no bones about charging him as an adult. "You have three individuals with bullets in their body. You have a store now absent its cash. It was done brutally, it was done recklessly, and it was done intentionally," says lead prosecutor Aaron Brooks. The public defender's office has already been assigned to defend Nicholas. Prosecutors say the crime fits the definition of an adult criminal matter. "When his conduct was evaluated and the evidence was reviewed, a decision was made that this is the proper treatment for the individual," Brooks says. Defense attorney Margaret Lagatudda has been assigned to the case. She did not return calls Thursday evening asking for comments on the case. In order to get the teen charged as an adult, prosecutors had to argue for what's called a juvenile transfer. The defense had filed a motion with juvenile court to block the move to adult court. The district attorney's office chose to move quickly based on the evidence they had obtained from the Rite Aid, witnesses, and others. Only $153 was taken and fortunately, not one of the three victims shot died. Veteran defense attorney Margaret Lagatudda recently defended multiple murderer Anthony Bell. Nicholas will next be transferred to the parish prison and he will be formally charged in front of Judge Don Johnson in two weeks.
